Terms of use
Last updated: November 2, 2026
Draft. These terms have not yet been reviewed by a lawyer.
These terms are an agreement between you and Jonathan Seth Dotterer ("we", "us") about your use of the RisingScore app and website (together, "RisingScore"). Please also read our privacy policy, which is part of these terms.
By creating an account, or by using RisingScore in any way, you agree to these terms and the privacy policy. If you don't agree, don't use RisingScore.
When you agree, you also confirm that:
- You are old enough and legally able to agree to these terms, or your parent or guardian has agreed to them for you (see section 1).
- If you set up or run a team for a club, school or other organization, you have the authority to agree to these terms on its behalf, and "you" includes that organization.
- If you add information or video about another person, such as a diver, you have the right to do so and any consent the law requires, including a parent's or guardian's consent for a child.
1. Who can use RisingScore
- You must be at least 13 years old to create an account.
- If you are under 18, a parent or guardian must agree to these terms for you.
- One account is for one person. Keep your email account secure, because sign-in codes are sent there.
2. Teams
- Anyone can create a team and becomes its admin. Admins and coaches decide who joins, what role each person has, and who may stream.
- If you run a team, you are responsible for approving only people with a real connection to it, such as divers, their families and coaches.
- RisingScore is in early testing. Features may change, and the service may sometimes be unavailable.
3. Streaming and filming
Diving meets, practices and warm-ups are held in public or shared places. By using RisingScore, you understand and accept that athletes, coaches, officials and spectators at these events may be filmed and streamed by other people, and you have no expectation of privacy in what can be seen or heard on the pool deck or in the stands. This applies whether you are the one filming, being filmed, or watching.
When you stream or upload, you promise that:
- You are allowed to film at that pool and meet, and you follow the rules of the host facility, meet and governing body.
- You film only the competition and warm-ups. Never film locker rooms, changing areas, or anywhere people expect privacy.
- You stop or remove video if a diver, or a diver's parent or guardian, reasonably asks.
- You don't rebroadcast, download or share a team's streams outside RisingScore without the team's permission.
4. Your content
You keep ownership of the video, scores, logos and other content you add ("your content"). You give us a worldwide, royalty-free, non-exclusive license to host, store, copy, process and show your content in order to run, secure and improve RisingScore. We show your team's content only to your team's approved members, unless you or your team choose to share it more widely.
Your consent to training and coaching use. By using RisingScore, you consent, for yourself and for anyone you have authority to consent for (including a child in your care), to the following uses of video, audio, scores and related information collected through RisingScore:
- Coaching assistance. We may analyze recordings, including body position and movement during a dive, to give divers, their families and their coaches feedback, form analysis and other coaching features within their team.
- Training and improving our products. We may use recordings and scores to research, build, train, test and improve our products, including machine-learning and artificial intelligence models (for example, models that analyze diving form or estimate scores). We use this data in de-identified form wherever we reasonably can, meaning names, accounts and other details that directly identify a person are removed, and it is combined with content from many teams.
- Analytics. We may use information in de-identified or aggregated form to understand how RisingScore is used.
We will not use this analysis to identify who someone is, and we will not sell it. We will not publish or release video of an identifiable person outside their team, publicly or to third parties, without consent from that person, or from a parent or guardian for a minor. If you don't want your or your child's recordings used for training, contact us at support@RisingScore.app and we will stop using them for new training.
The license to show your content to your team ends when it is deleted, except for copies kept in backups for a short time. The license for de-identified and aggregated use continues after deletion, because that information can no longer be tied back to you, and models already trained can't "unlearn" it.
5. Our software and your license to use it
RisingScore, including the app, website, software, designs, logos and the RisingScore name, belongs to us and our licensors and is protected by copyright, trademark and other laws. We give you a personal, limited, non-exclusive, non-transferable and revocable license to use RisingScore for its intended purpose while you follow these terms. We keep all rights we don't expressly give you.
6. Things you must not do
You agree that you will not, and will not help or allow anyone else to:
- Use RisingScore to break any law or regulation, or to infringe anyone's rights, including privacy and intellectual property rights.
- Harass, bully, threaten, exploit or embarrass anyone, especially young athletes.
- Post anything sexual, violent, hateful, defamatory or illegal.
- Enter scores or information you know are false.
- Get into, or try to get into, a team, account or stream you haven't been approved for, or share your sign-in with others.
- Copy, modify, translate, or make works based on any part of RisingScore.
- Reverse engineer, decompile, disassemble or otherwise try to discover RisingScore's source code, models or underlying ideas, except where the law expressly allows it despite this restriction.
- Sell, rent, lend, sublicense or otherwise make RisingScore available to others outside its normal features.
- Scrape, crawl, record, download or harvest streams, content or data from RisingScore, by automated tools or by hand, except through features we provide.
- Use RisingScore or its content to build or train a competing product or model.
- Get around, disable or interfere with security features, access controls, stream keys or usage limits.
- Upload viruses or harmful code, or overload, disrupt or damage RisingScore or the networks it runs on.
- Remove or change any copyright, trademark or other notices.
We may remove content, or suspend or close accounts, that break these rules, and we may report illegal activity to the authorities. Report a problem to support@RisingScore.app.
7. Fees
RisingScore is free during early testing. If we start charging, we will tell you the price first, and you won't be charged without agreeing.
8. Ending your use
You can leave a team or ask us to delete your account at any time. We may suspend or close accounts that break these terms or put others at risk. If you have not paid us anything, we may also remove your content or close your account at any time, for any reason. We will try to give notice first. Sections 3, 4, 5, 9, 10, 11 and 13 still apply after your account closes.
9. No guarantees
RisingScore is provided "as is." Live streams can drop, lag or fail, and scores entered by team members may contain mistakes. Official results are those from the meet's officials, not RisingScore.
10. Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for content added by other users. Our total liability to you is limited to the greater of the amount you paid us in the last 12 months or $100.
11. Indemnification
To the extent the law allows, you agree to defend, indemnify and hold harmless Jonathan Seth Dotterer and its owners, officers, employees, contractors and agents from and against any claims, demands, losses, damages, liabilities, costs and expenses, including reasonable attorneys' fees, that arise from or relate to:
- your use or misuse of RisingScore;
- content you stream, upload or post, including video of other people;
- your breaking these terms or any law; or
- your violation of anyone else's rights, including privacy, publicity and intellectual property rights.
If you run a team for an organization, this also covers the activity of that team. We may take over the defense of any claim at our own cost, and you agree to cooperate with us. You won't settle a claim that affects us without our written consent.
12. Changes to these terms
If we make important changes, we will tell you in the app or by email before they take effect. If you keep using RisingScore after that, you accept the new terms.
13. Governing law
These terms are governed by the laws of the State of Connecticut, USA.
